On Thursday June 29, 2025, FCRA Insight presents a 2-day intensive seminar on settlement and mediation. Ian Lyngklip of Lyngklip & Associates will host the program which will be held at the Hyatt Place in Royal Oak Michigan, 15 minutes from Downtown Detroit.
The Settlement and Mediation intensive will begin on Thursday (May 29) from 8:00 AM to 5:00 PM and conclude on Friday (May 30) from 8:00 AM – 3:00 PM. The hotel will provide breakfast for guests of the hotel and Insight will host lunch on Thursday and Friday and dinner on Thursday night. For those arriving early, there will be an informal round table discussion on FCRA practice, with emphasis on emerging challenges for small and solo firms in the current environment.
About the Program
The FCRA Insight Negotiation and Settlement program will provide you a framework for settling cases starting with the intake process, providing negotiation skills, and taking you through the necessary provisions of settlement agreements. This program is the culmination of 30 years of FCRA practice, negotiating and settling cases with CRAs and Furnishers. The focus is on practical skills to help you improve your settlement values in less time, with better agreements.
Foundations of Insight
The FCRA Insight method relies upon Lean Management fundamentals to deploy, evaluate, and improve processes in your law office, with the end goal of increasing profit. The FCRA Insight Kickstart will help practitioners to evaluate new approaches best suited to their respective offices and clients. Along the way, we will rely upon data analysis, cognitive psychology, collaboration models, and a host of other disciplines to boost results, one process at a time. And with each FCRA Insight Kickstart Module, we will feature the latest & greatest technology to ensure that you not only learn the aforementioned principles but are able to leave the Kickstart able to implement those principles.
Settlement and Negotiation Agenda
The Settlement and Mediation Intensive will cover core topics in getting the things your client needs out of a settlement and how to negotiate for that bargained consideration. Topics include
- Negotiation theory and practice.
- When and how to start your negotiations.
- Why classic negotiation models and "Never Split the Difference" negotiations fail in FCRA cases.
- Keeping judges and magistrates from forcing settlements.
- Critical inflection points in the litigation and managing microaggressions by opposing counsel.
- Weaponizing confidentiality, non-Disparagement, and ethics of settlement agreements
- Tracking data and knowing the value of cases where you litigate
- Using 26(f) and Rule 16 conferences to establish settlement expectations
- Recognizing pitfalls, holding your round and having a game plan for settlement conferences and mediations.
In addition to these topics, the Settlement and Negotiation Intensive will offer Group Coaching on fact patterns brought by the attendees as well as those shared by the speakers.

Following the Insight program, the insight staff will continue to work with attendees to assure their continued success with the program and materials. The FCRA Insight Kickstart aftercare includes:

Participation
This program will rely heavily on participation from attendees to share experiences and advice in a collaborative setting. Come prepared for Q&A with one of NACA and NCLC’s most demanded speakers. This program has space for only 20 participants who have previously attended an FCRA Insight program. Past participants in the Kickstart are welcome to attend the Settlement and Negotiation program.
